MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 9, 2012 <br />majority of the piece of property in question with within the flood zone of <br />Gervais Lake. The City Planner recommended approval of the property <br />division and combination as requested. <br />Adrianne Kneeland, 695 County Road B -2, indicated that she and her <br />husband would like to divide the parcel from their lot and give it to their <br />daughter so that she has lake access. Kneeland acknowledged that this <br />piece of land is unbuildable, but would provide her daughter's lot with <br />lake access. Kneeland indicated that eventually she and her husband will <br />be selling their property and they wanted to ensure that their daughter's <br />property continued to have lake access. <br />Barraclough indicated that he looked at the property and agreed that this <br />would he a nice addition to the Greenbrier property. <br />Duray asked if the Kneeland's had any issue with the Planner's <br />recommendations. Kneeland asked if the parcel could remain separate and <br />not be combined with the Greenbrier lot. The City Planner indicated that <br />it would have to be combined in order to meet Code regulations. The City <br />cannot create a parcel of land without street frontage. <br />Kneeland asked about the recommendation that addresses metes and <br />bounds legal description versus platting of the property. The City Planner <br />indicated that in order to record the property division, the County may <br />require the division be platted. This is an issue that the Kneeland's will <br />have to address with the County. The Planner indicated that the <br />Kneeland's surveyor can help them through this process. If a plat is <br />required, an additional zoning action may be necessary. <br />Kneeland asked about the requirement for dedication of easements. The <br />City Planner noted that Code requires the dedication of parameter <br />easements for property divisions. He indicated that the Kneeland's <br />surveyor can describe those easements on the plat, or in the case of a <br />metes and bounds property division get the easement descriptions to the <br />City for preparation of an easement document. <br />Kristen Taton, Greenbrier Circle, noted that they had no intention of <br />putting a house on this property but asked if a shed or gazebo would be <br />permissible. The City Planner replied that the property would be eligible <br />for accessory buildings as long as they were not located within the flood <br />zone. He suggested that Taton contact the Building Official for specific <br />information. <br />Barraclough recommended approval of the Subdivision of the northerly 75 <br />feet of 695 County Road B -2 and Combination of that 75 feet with 2389 <br />Greenbrier Circle as requested by Mr. and Mrs. Kneeland subject to <br />-2- <br />
