MEMORANDUM <br />TO: Mayor Blesener & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: August 18, 2006 <br />RE: Amendment to CUP's — Lee Rossow <br />The Planner and I met with Mr. Rossow regarding his desire to have more flexible outdoor <br />storage arrangements for his properties in Ryan Industrial Park. We informed Mr. Rossow that it <br />was not likely the City Council would grant a "flexible" CUP given the difficulty in generating <br />appropriate and enforceable standards coupled with the issue that a CUP runs with the property. <br />We discussed another approach whereby the City would create an interim use (we discussed an <br />initial two year term with a possibility for a two year extension) to allow a more flexible outdoor <br />storage option that would be eliminated at the expiration of the interim use. An additional <br />consideration would require redevelopment of the site to provide for new buildings that would <br />upgrade the construction quality within the park. (A PUD permit would be required for Mr. <br />Rossow's property at 194/196 Ryan Lane to allow two buildings on one parcel given the <br />limitations the site poses given its unique shape and the impacts of pipelines and towers that <br />further constrict buildable areas.) <br />As a result of this discussion, it would be staffs recommendation that we deny the CUP <br />amendments as applied for based on the lack of specificity in the outdoor storage areas and the <br />associated difficulty in controlling same. Staff would further recommend we direct the Planner <br />to prepare a text amendment for the 1 -1 district to allow a more "flexible" outdoor storage <br />possibility as an interim use. This will require the creation of appropriate standards to give us a <br />modicum of control in the interim period. <br />Finally, staff would also recommend we consider the use of tax increment financing to assist <br />with building upgrades in the Ryan Industrial Park with the increments to be used to offset the <br />higher construction costs associated with the poor soils (similar to the District Council project on <br />the former Knox property). This concept is subject to statutory provisions relative to the creation <br />and use of TIF for such a purpose. <br />The Planner will be prepared to discuss this in greater detail at Wednesday's meeting. <br />cc: Lee Rossow <br />
