MINUTES
CITY COUNCIL
MAY 24, 2006
AMENDMENT
TO ZONING
CODE —
IMPERVIOUS
SURFACE &
SECOND
CURB CUTS
in most cases people were moving small businesses from their homes and
into commercial locations. Rossow reported that he receives very few
inquiries from larger enterprises.
Blesener again noted the need for staff to put together some options that
will tighten the City's control over outdoor storage while allowing
property owners the reasonable use of their property. It was the consensus
of the Council that there should be a reasonable ratio of building rental
space to outdoor storage space and not the minimum numbers discussed at
the Planning Commission meeting.
Mr. LaValle introduced the following resolution and moved its adoption:
RESOLUTION NO. 2006 -5 -119 — TABLING ACTION ON THE
AMENDMENTS TO CONDITIONAL USE PERMITS FOR 194/196,
3164, AND 3175 RYAN LANE REQUESTED BY LEE ROSSOW
UNTIL THE JUNE 28, 2006 REGULAR COUNCIL MEETING
CONTINGENT UPON MR. ROSSOW SIGNING A SIXTY -DAY
WAIVER AGREEMENT
The foregoing resolution was duly seconded by Allan.
Ayes (5).
Nays (0). Resolution declared adopted.
Blesener opened the Public Hearing to consider an Amendment to the
Zoning Code Chapter 903.050, relative to the issue of impervious
surface and curb cut accesses for detached single - family dwellings.
The City Planner and Planning Commission recommended approval
of the amendment as proposed.
The City Planner presented the background on this proposed amendment,
noting that the Council recently amended the Code to allow second curb
cuts for single- family properties by Conditional Use Permit provided that
certain conditions are met. One of these conditions was that the
impervious surface area on the property cannot exceed 30 %, although it
was the intent of the Council to grandfather in any properties that already
exceeded this amount. The Planner noted that the property owner that
requested the initial amendment exceeds the 30% impervious surface
limitation on his property. The Planner reported that the amendment
before the Council this evening reflects the Council's intent allowing a
second curb cut provided that no additional impervious surface is added if
the property is already at or over 30 %. It also allows the City to require
additional storm water management measures to resolve new or existing
drainage issues.
6
