MINUTES <br />CITY COUNCIL <br />JUNE 28, 2006 <br />LEE ROSSOW <br />RESOLUTION NO. 2006 -6 -146 — CONTINUING THE PUBLIC <br />HEARING ON THE AMENDMENTS TO CONDITIONAL USE <br />PERMITS FOR 194/196, 3164, AND 3175 RYAN LANE UNTIL THE <br />JULY 26, 2006 COUNCIL MEETING AS REQUESTED BY MR. LEE <br />ROSSOW <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4) <br />Nays (0). Resolution declared adopted. <br />PROPERTY Mayor Blesener opened the Public Hearing to consider the request of <br />COMBINATION - Patricia O'Neil to combine property at 640 LaBore Road and 675 <br />640 LABORE Keller Parkway into one single - family lot. The City Planner and the <br />ROAD AND Planning Commission have recommended approval subject to the <br />675 KELLER conditions outlined in the City Planner's report dated June 5, 2006 and <br />PARKWAY — subject to the proposed sports court meeting all City Code regulations, <br />PATRICIA including fencing and lighting regulations. Blesener noted that Mrs. <br />O'NEIL O'Neil is proposing to construct a sports court on her property that would <br />be a paved surface with a basketball net. <br />Dean Hedlund, 655 Keller Parkway, reported that he is happy that Mrs. <br />O'Neil is proposing to demolish the existing house at 640 LaBore Road <br />and combine the two properties. Hedlund stated that it is his <br />understanding that under City Code the sports court could be within 10 <br />feet of his property line. The City Planner replied that that is correct. <br />Hedlund stated that he would request that the sports court be no closer to <br />his property than where the existing house at 640 LaBore Road is Located. <br />The City Planner noted that the construction of the sports court is not <br />related to the property combination request. Therefore, conditions on the <br />sports court would not be appropriately tied to the property combination. <br />Blesener noted that Mrs. O'Neil indicated at the Planning Commission <br />meeting that she would place the sports court approximately 56 feet from <br />the Hedlund property line. <br />Montour asked if a building permit would be required for the sports court. <br />The City Planner replied that the paved surface would not require a <br />building permit provided that the court is located in the rear yard of the <br />property. <br />Hedlund asked how much landscaping could be done without a permit. <br />The City Planner replied that Landscaping does not require a building <br />2 <br />
