The Contractor shall report all violations of ordinances pertaining to garbage <br />and refuse collection and disposal for enforcement purposes including all <br />unsanitary or filthy conditions to the City. <br />6. Safety. The Contractor shall provide and maintain all sanitary and safety <br />accommodations for the use and protection of its employees as may be necessary <br />to provide for their health and welfare and comply with federal, state, and local <br />codes and regulations, as well as those of other bodies and tribunals having <br />jurisdiction. Employee safety and sanitation facility regulations are set forth in <br />Minnesota Statutes 182 and in the Department of Labor and Industry's Labor <br />Safety Code (LISC 73 -75). <br />E. Payment Method. <br />1. Refuse and Recycling Collection Service. The resident /property owner shall pay <br />the Contractor one price for refuse disposal service, refuse collection service, and <br />recyclable one price for single sort recycling collection service as outlined in <br />Attachment "A ". The c st f r refuse disposal service is directly tied t the <br />tipping fees at the NRG facility and therefore must be adjusted up r down on a <br />pro rata basis as the tipping fees change and by no later than thirty (30) days for <br />any increase or reduction in tipping fees. Any fee changes must be agreed upon <br />by the City and Contractor. There shall be no provisions for any price increase <br />for collection, recycling, senior bag rate, or optional town home rate, once <br />established. <br />2. Disposal Fees. The resident owner shall pay the Contractor one price for a disposal <br />fee as outlined in Attachment "A ". The cost for refuse disposal service is directly <br />tied to the tipping fees at the NRG facility and therefore must be adjusted up or <br />down on a pro -rata basis as the tipping fees change and by no later than thirty <br />(30) days for any increase or reduction in tipping fees. Failure by the <br />Contractor to make upward adjustments in the allotted time may not be <br />retroactively applied. The City shall be provided with appropriate <br />documentation from the Contractor associated with any change in billing <br />rates associated with modifications to tipping fees.
