MINUTES <br />CITY COUNCIL <br />JULY 26, 2006 <br />CUP & € . <br />VARIANCE — <br />2958/29G,0` <br />YORKTON <br />BLVD. • <br />ADVANCED <br />MASONRY <br />RESTORATION <br />StRETROPIT <br />RECYCLING <br />Mayor Blesener opened the Public Hearing to consider a Conditional <br />Use Permit for open and outdoor storage as an accessory use as well as <br />a Variance to allow open and outdoor storage in a side yard for the <br />property owned by Advanced Masonry Restoration located at 2958/2960 <br />Yorkton Blvd. It was noted that the City Planner and the Planning <br />Commission have recommended denial of the Variance, but recommended <br />approval of the Conditional Use Permit subject to conditions. <br />The City Planner noted that outdoor storage is allowed in the I -P District <br />by Conditional Use Permit, however, the location of outdoor storage is <br />restricted to the rear yard of the property. Given the AMR property is a <br />corner lot, and the Code defines front yard as the narrow side of a corner <br />lot, the AMR outdoor storage location is technically in the side yard of the <br />property. The Planner indicated that other than location, the outdoor <br />storage proposed meets all Code requirements. <br />Keis noted that the AMR building has two addresses on Yorkton Blvd. <br />and one address on Yorkton Court. Tom Kromroy, AMR, indicated that <br />the 2958 Yorkton Blvd. address is the official address of the property. <br />The other two addresses are tenant addresses utilized for postal delivery. <br />The City Planner noted that front yard of a property is determined under <br />City Code to be the narrow side of a comer lot and is not based on street <br />address. The Planner reported that this Code provision was established to <br />address the determination of setbacks for undeveloped properties. It <br />allows the Building Official to determine required setbacks for properties <br />as they are being developed. <br />Blesener noted the letter received from United Scientific in support of <br />AMR's Conditional Use Permit and Variance request. Blesener asked if <br />the same front yard interpretation applied to the United Scientific <br />property. The City Planner indicated that it would, and the north end o f <br />the United Scientific property would be considered the rear yard of this <br />property. <br />Kromroy noted that his business, AMR, has occupied the building since <br />1999 and purchased the building in March of 2006. Since that time, AMR <br />has made over $250,000 in building improvements. The building is 100% <br />occupied. Kromroy reported that Retrofit Recycling is one of the major <br />tenants of the building and also need outdoor storage. <br />Kromroy reported that as a result of painting the building and repaving of <br />the parking lot, trucks and equipment were moved to the boulevard area <br />and the street.
