MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 14, 2006 <br />Knudsen recommended denial of the Special Use Permit for a home <br />occupation providing spa services including yoga, manicures, pedicures, <br />and massage as well as denial of a Text Amendment to Chapter 2202 <br />relative to massage therapy as an accessory use in residential zoning <br />districts as proposed by Mary Vasquez, 140 Rose Place East, based on the <br />commercial intensity of the proposed home occupation and the resulting <br />impact on the residential neighborhood. <br />Motion seconded by Rheaume. <br />Motion carried 5 — 2. Knudsen, Barraclough, Duray, Rheaume, and <br />McGraw voted in favor. Hall and Socha against. <br />CUP — Mr. Paul Theisen appeared before the Commission requesting approval of <br />2580 RICE a Conditional Use Permit to operate a massage therapy business as a <br />STREET — principal use in the General Business District (B -3) at 2580 Rice Street as <br />NOUPATH as well as a Text Amendment to Chapter 2203 relative to the number of <br />MASSAGE massage therapists allowed. Theisen reported that his business would be <br />open six days per week with limited hours on Saturday. Theisen reported <br />that there is adequate parking to accommodate the business. He reported <br />that his employees and manager would be certified massage therapists. <br />Rheaume noted that Theisen's floor plan shows three massage therapy <br />rooms, and asked if that was the number needed to make the business <br />viable. Theisen replied that it was. <br />Knudsen pointed out that the Code allows two massage therapist licenses <br />issued to any one massage therapy business. Rheaume asked if three <br />would be enough, or if Theisen foresaw that he may request more licenses <br />in the future. Theisen felt that three licenses would be adequate, and felt <br />that he would likely have only two therapists working at any given time. <br />Duray asked if the business would occupy the first level of 2580 Rice <br />Street. Theisen replied that it would, while the lower level is a small one <br />person office. <br />Duray asked about parking. The City Planner reported that there are 90 <br />parking spaces available for the entire complex, and he anticipated that the <br />parking would be adequate. Theisen noted that his business would be by <br />appointment only, and he anticipated using five spaces at maximum at any <br />one time. <br />6 <br />
