Hanson <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Kathy Glanzer, City Clerk <br />DATE: July 21, 2006 <br />RE: Conditional Use Permit & Variance — Advanced Masonry Restoration <br />Advanced Masonry Restoration submitted a letter withdrawing their request for a <br />Conditional Use Permit for outdoor storage at 2960 Yorkton Blvd. Tom Kromroy, AMR, <br />indicated that they would be eliminating the outdoor storage of equipment and materials, <br />therefore, his business would no long require a CUP for outdoor storage. <br />In discussing vehicular parking with the City Planner, it is his interpretation of the <br />ordinance that given AMR's vehicles have a gross vehicular weight of Tess than 12,000 <br />lbs., they are not considered to be outdoor storage. This interpretation has been applied <br />in other instances as well, i.e. the Watershed's outdoor parking of vehicles on their site. <br />Therefore, the elimination of outdoor storage of equipment and materials with only <br />AMR's vehicles does result in no need for a CUP for the AMR portion of the site. <br />With regard to the Retrofit Recycling parking, the ordinance allows the parking of a <br />vehicle at a loading dock, plus one additional vehicle waiting. Given the three truck <br />docks utilized by Retrofit Recycling, they would be allowed six vehicles larger than <br />12,000 lbs. without triggering outdoor storage requirements. However, Retrofit has 13 <br />vehicles; therefore, a CUP for outdoor storage would be required for this business. <br />In discussing this with Tom Kromroy, AMR, he has now withdrawn his withdrawal of <br />the CUP application. Kromroy indicated that it had been his understanding that no CUP <br />was needed for the entire property. Kromroy was informed that a CUP would still be <br />needed for the Retrofit Recycling business. Kromroy then indicated that he wanted to <br />proceed with both the CUP and the Variance for the entire property, including the AMR <br />outdoor storage as originally proposed. <br />Retrofit Recycling will be submitting a separate site plan for their outdoor storage on <br />Monday. Retrofit felt that they would be able to contain their outdoor storage within the <br />rear yard of the property, thus not requiring a Variance. This site plan will be forwarded <br />to the City Planner for his review in preparation for Wednesday's meeting. <br />
