MINUTES <br />CITY COUNCIL <br />JULY 25, 2001 <br />CONSENT <br />AGENDA <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Montour, Anderson, Scalze. <br />Nays (0). Resolution declared adopted. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001 -7 -159 — APPROVING THE CONSENT AGENDA <br />WHICH CONTAINS THE FOLLOWING: <br />*APPROVAL OF THE 22nD RIDER TO THE BOARD OF WATER <br />COMMISSIONERS AGREEMENT AND AUTHORIZING THE MAYOR <br />AND CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY; <br />*APPROVAL_ OF T. A. SCHIFSKY & SONS PAY REQUEST FOR 2001 <br />STREET IMPRO VMENTS AS RECOMMENDED 13Y THE PUBLIC <br />WORKS DIRECTOR; <br />*APPROVAL OF THE CANADIAN DA ES' TRAILER AGREEMENT AND <br />AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Montour, Anderson, Fahey. <br />Nays (0). Resolution declared adopted. <br />CUP'S FOR Scalze pointed out the discussion of the Planning Commission relative to <br />ACCESSORY conditional use permits for accessory garages as well as her concern that <br />GARAGES these garages could be used by property owners for work on vehicles, etc for <br />other than immediate family. <br />The City Planner noted that his reports reference that use of these garages is <br />limited to personal vehicles. If vehicles other than those owned personally by <br />the property owner are being stored or worked on in these garages, this would <br />technically be a violation of the CUP. While it is a policing issues, the City <br />would have the authority to revoke a CUP and order the building removed. <br />Scalze suggested that the approval notification form sent to property owners <br />include the conditions of approval and that the property owner be required to <br />sign a copy of the form and return it for the City's records. That form should <br />also reference that violation of these conditions could result in revocation of <br />the CUP. <br />
