Illicit Discharges and Connections <br />(a) Connection to the City's MS4 System. <br />1) New direct connections and replacement of eristinz cann¢u'ticros shall <br />be completed lain,/ a method that is approved In' the City. <br />(2) Peak flow rate, the total volume of flow. and the timing of the flow <br />for new connections must be managed to not cause new water <br />conveyance problems. <br />(h) Discharge Prohibitions. <br />) Prohibition of ❑le ;al Discharges. No erson shall discharge or cause <br />to be discharged into the municipal storm drain system or watercourses <br />any materials, including but not limited to pollutants that cause or <br />contribute to a violation of applicable water quality standards. other than <br />storm water. <br />(2) Prohibition of Illicit Connections. The construction use, <br />maintenance or continued existence of illicit connections to the stolen <br />drain system without a City permit is prohibited. <br />(i) This prohibition expressly includes, without limitation. illicit <br />connections made in the past, regardless of whether the <br />connection was permissible under law or practices applicable or <br />prevailing at the time of connection. <br />A person is considered to be in violation of this Rule if the <br />person connects a line conveying sewage to the City's MS4. or <br />allows such a connection to continue. <br />(c) Suspension of MS4 Access. <br />fl) Suspension due to Illicit Discharges in Emergency Situations. The <br />City may, without prior notice, suspend MS4 discharge access when <br />such suspension is necessary to stop an actual or threatened dischar <e <br />which presents or tnav present imminent and substantial danger to the <br />environment, or to the health or welfare of persons. or to the City's MS4 <br />or Waters of the United States. If the violator fails to comply with a <br />suspension order issued in an emergency, the City may take such steam <br />as deemed necessary to prevent or minimize damage to the City's MS4 <br />or Waters of the United States. or to minimize clanger to persons or the <br />environment:. <br />Model Stormwater Ordinance Page 12 NEMO Ordinance Project <br />- 1 6 - <br />Deleted: <q>No person shall cause any <br />illicit discharge to enter the municipal <br />storm water system unless such <br />discharge: (I) consists of non -storm water <br />that is authorized by an NPDES point <br />source permit obtained from the MPCA; <br />or (2) is associated with fire fighting <br />activities; or (3) is otltenvise in <br />compliance with community chapter <br />referral, ifnecessary).1 <br /><g>No person shall use any illicit <br />connection to intentionally convey non - <br />stonn water to community storm water <br />system.¶ <br />
