Hanson <br />www.ctlittle-canadaann.us <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: October 6, 2006 <br />RE: Vacation of Portion of Country Drive Road Right -Of -Way <br />RAB, LLC — Sign Placement <br />RAB, LLC desires to place a monument sign at their new building located at 2935 <br />Country Drive. Given the extra wide right -of -way area, the property owner does not have <br />room between the curb line and the right -of -way to install the proposed sign (see <br />attached). Staff has reviewed this matter and believes we can vacate a portion of the <br />right -of -way while still leaving the City in excess of 60 feet of right -of -way <br />(approximately 11 feet of right -of way would be vacated - see attached diagram). <br />Public Works has reviewed this issue and noted that the City's sanitary sewer line will be <br />very close to the sign location. To address that concern, staff would recommend that the <br />vacation of right -of -way be subject to the retention of utility easements over the vacated <br />area, and would be subject to a recorded acknowledgement whereby the property owner <br />will bear any and all costs associated with damage /removal /reconstruction of said sign <br />should it be necessary due to the City's work on either the water main or sewer line. <br />At this time staff would recommend that Council call for a public hearing to vacate the <br />right -of -way subject to the developer paying all associated costs and as well as subject to <br />the above acknowledgement. The vacation hearing would be held October 25, 2006. <br />
