Agreement # 02- <br />CONTRACT FOR WATER SERVICES <br />between <br />BOARD OF WATER COMMISSIONERS <br />and <br />CITY OF LITTLE CANADA <br />This AGREEMENT, made and entered into effective , 2006, <br />by and between the CITY OF LITTLE CANADA ( "Little Canada "), a municipal corporation under <br />the laws of the State of Minnesota, and the BOARD OF WATER COMMISSIONERS OF TFIE <br />CITY OF SAINT PAUL, ( "Board "), a municipal corporation under the laws of the State of <br />Minnesota. <br />WITNESSETH: <br />WHEREAS, the Board has been providing water to Little Canada on a wholesale basis <br />continuously since 1970; and <br />WHEREAS, the Board and Little Canada amended the 1970 contract in 1989 to reduce rates <br />due to a change in the delivery requirements and to extend the term of the contract by seven years; <br />and <br />WHEREAS, the Board and Little Canada further amended the 1970 contract in 1991 to <br />require the Board to furnish, install and maintain the master meter which measures the amount of <br />water sold to Little Canada; and <br />WHEREAS, the Board and Little Canada have discussed the feasibility of an agreement that <br />would result in the Board owning and operating the Little Canada water system; and <br />WHEREAS, the Board and Little Canada have agreed that continuance of a wholesale <br />agreement is most appropriate at this time, but are willing to enter into further discussions regarding <br />an acquisition agreement in the future; and <br />V:\Engineering\BTSCHIDA\ Agreements \Water Service \Little Canada\Little Canada 10-18-06 doe 1 <br />-2- <br />
