Page 15 of 20 <br />(A) Scope: The provisions of this Section shall govern the minimum mechanical and electrical facilities <br />and equipment to be provided. <br />(B) Responsibility: The owner of the structure shall provide and maintain mechanical and electrical <br />facilities and equipment in compliance with these requirements. A person shall not occupy as owner - <br />occupant or permit another person to occupy any premises which does not comply with the <br />requirements of this Section. (Ord. 706, 3 -16 -1998) <br />4 1 -6 -2: HEATING FACILITIES: <br />(A) Facilities Required: Heating facilities shall be provided in structures as required by this Section. <br />(B) Residential Occupancies: Dwellings shall be provided with heating facilities capable of maintaining a <br />room temperature of seventy two degrees Fahrenheit (72 °F) in all habitable rooms, bathrooms and <br />toilet rooms based on the winter outdoor design temperature required for the locality by the building <br />code located at Section 4 -1 -1 of this Title. <br />(C) Heat Supply: Every owner and operator of any building who rents, leases, or lets one or more <br />dwelling unit, rooming unit, dormitory or guest room on terms, either expressed or implied, to furnish <br />heat to the occupants thereof shall supply heat during the period from October 1 to May 1 to maintain <br />a temperature of not less than sixty five degrees Fahrenheit (65 °F) in all habitable rooms, bathrooms, <br />and toilet rooms. <br />Exception: When the outdoor temperature is below the winter outdoor design temperature required for <br />the locality by the building code, maintenance of the minimum room temperature shall not be required <br />provided that the heating system is operating at its full design capacity. <br />(D) Occupiable Work Spaces: Indoor occupiable work spaces shall be supplied with heat during the <br />period from October 1 to May 1 to maintain a temperature of not less than sixty five degrees <br />Fahrenheit (65 °F) during the period the spaces are occupied. <br />E ;options: <br />1. Processing, storage and operation areas that require cooling or special temperature conditions. <br />2. Areas in which persons are primarily engaged in vigorous physical activities. <br />(E) Room Temperature Measurement: The required room temperatures shall be measured three feet (3') <br />above the floor near the center of the room and two feet (2') inward from the center of each exterior <br />wall. (Ord. 706, 3 -16 -1998) <br />1 3 -6 -3: MECHANICAL EQUIPMENT: <br />(A) Mechanical Equipment: All mechanical equipment, fireplaces and solid fuel- burning appliances shall <br />be properly installed and maintained in a safe working condition, and shall be capable of performing <br />the intended function. <br />(B) Cooking And Heating Equipment: All cooking and heating equipment, components and accessories in <br />every heating, cooking and water - heating device shall be maintained free from leaks and obstructions. <br />1. Cooking Equipment: Cooking appliances shall not be used to provide space heating to meet the <br />minimum requirements of subsection 4- 8- 6 -2(g. of this Chapter. <br />2. Fireplaces: Fireplaces shall not be used to provide space heating to meet the minimum <br />requirements of subsection 4- 8- 6 -2(C) of this Chapter. <br />3.
