ORDINANCE NO. 1002 <br />Page 10 <br />A. Hearing. Following receipt of a notice of denial or non - renewal issued under <br />Section 3 -28 -4 of this Chapter or a notice of a violation and penalty issued under Section 3 -28- <br />10 of this Chapter, an applicant or license holder may request a hearing before the City Council. <br />A request for a hearing shall be made by the applicant or license holder in writing and filed with <br />the City Manager or City Manager's designee within ten (10) days of the mailing of the notice of <br />denial or alleged violation. Following receipt of a written request for hearing, the applicant or <br />license holder shall be afforded an opportunity for a hearing before a committee consisting of the <br />City Manager or City Manager's designees. After the committee conducts the hearing it shall <br />report its findings and make a recommendation to the full City Council. <br />B. Findings. If after the hearing the applicant or License Holder is found ineligible <br />for a license, or in violation of this ordinance, the Council may affirm the denial, impose a civil <br />penalty, revoke a license or impose any combination thereof as set forth in Section 3 -28 -4 or <br />Section 3- 28 -10. <br />C. Default. If the applicant or License Holder has been provided written notice of <br />the denial, non - renewal, or violation and if no request for a hearing is filed within the 10 day <br />period, then the denial under Section 3 -28 -4 or civil penalty or revocation imposed in Section 3- <br />28-10 shall take immediate effect by default. The City Manager or designee shall mail notice of <br />the denial, fine, or revocation to the applicant or License Holder. The City Police shall <br />investigate compliance with the denial or revocation. <br />3- 28 -13: STAR PROGRAM FOR ALL LICENSE HOLDERS: <br />The City hereby creates a STAR Program for all Single Family and Multi - Family License <br />Holders. Participants in the program shall also be members of the City's STAR Program <br />Committee (the "BPPC ") which shall meet on a regular basis to give advice to the City Council <br />regarding the operation of the Program. Participation in the Program is voluntary. Application <br />for the Program must be made on application forms produced by the City. <br />A. Multi- Family. The following are the STAR required participation elements and <br />associated Participation Levels for Multi- Family buildings: <br />"C Level" Mandatory Participation: <br />Use a Crime Free Housing lease addendum or equivalent. <br />Provide the City a copy of rental criteria regarding persons with criminal <br />backgrounds. <br />Provide a copy of Third Party Background Check procedures for Tenants. <br />Provide a copy of Third Party Background Check procedures for Managers /Employees. <br />l0 <br />118908 <br />11/14/05 <br />
