Hanson <br />Attached is a revised agreement for dispatch services with Ramsey County relative to the <br />conversion to the 800 MHz system. When this Agreement was first drafted, it was estimated that <br />the new dispatch center would be operational around January of 2007. It now looks like it will <br />be closer to April of 2007 before the dispatch center will be operational. It is the County's intent <br />for this Agreement to be in three starting January 2007 and for the new dispatch costs to be <br />effective as of 1/1/07 for the communities that currently receive dispatch services from the <br />County. To that end, they have modified that language in the attached Agreement to make this <br />clearer. <br />Another concern was the County's lack of attention to language due to the Remer case that <br />involved agreements between political subdivisions. This case effectively stated that a claimant <br />could "stack" the liability limits of each political subdivision involved in ajoint venture. As a <br />result, the City Attorney wanted revisions to the County's agreement that would provide <br />protection against that issue. The County had been unwilling to make that change. However, the <br />legislature did take action this past session to reinstate a claimant's maximum potential recovery <br />to Minnesota's statutory tort liability limits. I have attached literature from the League of <br />Minnesota Cities Insurance Trust that addresses this issue. Subject to any comments by our City <br />Attorney, I believe this issue is resolved due to legislative action. <br />Therefore, staff would recommend the adoption of the revised Agreement for Dispatch Services. <br />
