MINUTES <br />PLANNING COMMISSION <br />JUNE 8, 2006 <br />CONDITIONAL <br />USE PERMIT — <br />32 MAPLE LANE <br />ZEWERS <br />permitted accessory use provided the court is not within required setbacks. <br />The Planner also noted that the Code addresses the issue of lighting and <br />prohibits the glare onto adjacent properties. <br />Dean Hedlund, 655 Keller Parkway, reported that his property is <br />immediately west of the O'Neil property on Keller Parkway. Hedlund <br />stated that he was happy with the removal of the house and garage at 640 <br />LaBore Road. Hedlund stated that if the proposed sports court is no closer <br />to his property than the 640 LaBore Road house, he has no issues of <br />concern. O'Neil indicated that the sports court would be further from the <br />Hedlund property than the 640 LaBore Road house and estimated the <br />distance at 56 feet. <br />Hall asked if, as a result of the property combination, the sports court <br />would end up adjacent to the neighbor's front yard. O'Neil replied that it <br />would be adjacent to their rear yard. <br />Duray suggested that the Commission require a specific setback for the <br />sports court as a part of the property combination. The City Planner <br />pointed out that the sports court is a permitted accessory use subject to <br />certain regulations, and suggested it would not be appropriate to impose <br />additional conditions on the sports court as a part of the property <br />combination action. The Planner noted that Mrs. O'Neil has indicated that <br />the sports court would be approximately 56 feet from the neighbor's <br />property line. <br />Knudsen recommended approval of the Property Combination combining <br />640 LaBore Road and 675 Keller Parkway into one single- family lot <br />subject to compliance with the recommendations of the City Planner as <br />outlined in his report dated June 5, 2006, and subject to the proposed <br />sports court meeting all City Code regulations, including fencing and <br />lighting regulations. <br />Motion seconded by Rheaume. <br />Motion carried 7 — 0. <br />Mr. Kevin Zewers, 32 Maple Lane, appeared before the Commission <br />requesting approval of a Conditional Use Permit to allow two garages <br />— (one attached and one detached) as well as total garage space of <br />approximately 1,448 square feet. Zewers reported that the second garage <br />is need for the storage of typical lawn maintenance equipment. He <br />indicated there will be no commercial use of his garage space. <br />3 <br />
