The original CUP was granted <br />for the purpose of allowing automobile sales and the outdoor storage of vehicles and <br />parts. <br />The applicants are seeking the amendment to allow the relocation of the sales area <br />from the rear of the property to the front of the site along Spruce Street. The relocation <br />of the sales lot would displace 16 of the originally required parking spaces. The staff <br />report, written in response to that application, estimated a required parking supply of 30 <br />spaces. Under the proposed amendment, just 14 spaces would remain. The applicant <br />is seeking the variance to reduce the parking supply from 30 spaces to 14. <br />A part of the applicant's objection to the original permit relates to drainage issues on the <br />site. The applicant contends that the sales area of the property is subject to flooding, <br />and the for -sale vehicles must be moved to a better location. He also suggests that the <br />business is no longer a sales operation — they wish to accept vehicles for general repair <br />on a "retail" basis — repairing cars for outside customers instead of resale only. The <br />applicant indicates a need to accommodate up to 150 vehicles for this activity. <br />Conditional Use Permit <br />There are several conditions attached to the original permit that were not complied with. <br />These include violations of the limitations on outdoor storage. failure to pave the parking <br />and sales lot areas, and paving of area :hat was required to be green space.
