The site is a .88 acre lot on Gervais Lake and is zoned <br />R -1, Single Family Residential. The site also lies in the Shoreland District. <br />Mr. Galba recently completed construction of a 928 square foot garage. The said <br />garage was completed without the necessary Conditional Use Permits, and the <br />applicant is now requesting them after the fact. <br />ANALYSIS <br />According to Section 903.020, the total floor area of a garage and other accessory <br />buildings for a single family detached dwelling shall not exceed 1,000 square feet of <br />floor area per lot, except by conditional use permit pursuant. In no instance shall the <br />total floor area of a garage and an accessory building for a single family dwelling <br />exceed 1,500 square feet. According to Section 903.020 (D) (5), single family lots are <br />each eligible for 1 garage structure, whether attached or detached, one recreational <br />accessory building, and an accessory shed. The construction of an additional garage <br />structure or accessory building requires a Conditional Use Permit. <br />At the time of construction, the applicant had an existing attached, two-stall, 560 square <br />foot garage. The applicant then constructed a second 928 square foot garage on the <br />property, for a total area of 1,490 square feet. These dimensions were verified by the <br />City's Building Official. In order to complete the construction of the second garage in <br />compliance with City regulations, the applicant needed two Conditional Use Permits. <br />One Conditional Use Permit is required for the construction of the second garage, and <br />one is required for accessory buildings with a total area over 1,000 square feet.
