1801. LOW LANDS, WETLANDS AND MARSHES <br />1801.010. DECLARATION OF POLICY. The City Council of Little Canada has <br />deteiiuined that it is in the public interest to prevent irreparable harm to valuable natural resources <br />by encouraging a coordinated land and water management program of those areas within the City <br />which comprise low lands, wetlands, marshes and all lands adjacent to lakes and watercourses. The <br />specific intent of this Ordinance is as follows: <br />(a) To minimize health hazards by protecting surface and ground waters from pollution <br />by providing proper drainage. <br />(b) To encourage the type of land development which will have the least adverse effect <br />on the natural flow of flood water and at the same time protect life and property. <br />(c) To encourage land uses which lead to the preservation of marshes and natural <br />vegetation in those areas where such conditions are an important factor in the <br />maintenance of constant water flow. <br />(d) To utilize the ponding concept and other methods to minimize fast run off of surface <br />waters from developed areas and to minimize the introduction of pollutional <br />materials from those areas into the natural waterways, ditches and lakes. <br />(e) <br />To prevent the obstructing of the free flow of water in the streams and ditches. <br />1801.020. DEFINITION AND ESTABLISIHMENT OF WETLAND AREA. The wetland <br />conservation area within the City of Little Canada is defined and established to be the shorelines of <br />Gervais Lake, Savage Lake, Round Lake and Twin Lake and the low areas adjoining any <br />watercourse and drainage way, natural or man -made, subject to meandering, flowing or overflow, <br />including areas of marsh, wooded marsh, submerged marsh and inundation areas as shown on the <br />wetlands map, attached hereto and made a part hereof by reference. <br />1801.030. REGULATION OF DEVELOPMENT. Any person, firm or corporation desiring <br />to develop, improve or alter land or build any structure upon land located within the wetland <br />conservation area or change the shoreline of any lakes within the area shall first <br />submit a development plan to the City Council which shall contain provisions for water <br />management, sediment control, maintenance of landscape features and any other matters which <br />pertain to the quality of the environment. Said plan shall show all changes proposed in the natural <br />condition of the soils, destruction of or relocation of trees, grade changes and the anticipated affects, <br />if any, such changes may have upon the immediate surrounding area. <br />1801.040. CERTAIN DEVELOPMENT PROHIBITED. No development, including <br />excavation, filling, dredging, grading and construction shall be allowed within the wetland <br />conservation area if such is incompatible with the policies expressed in this Ordinance and the <br />preservation of said wetlands in their natural state.
