3/31/06 <br />DEVELOPMENT CONTRACT <br />THE PRESERVE <br />THIS CONTRACT, MADE THIS day of , 2006, by and between the <br />City of Little Canada, a municipal corporation of the State of Minnesota (hereinafter referred to <br />as the "City ") and Dayspring Development, LLC, a Minnesota limited liability corporation, <br />owner and subdivider (hereinafter referred to as the "Developer "). <br />WITNESSETH: <br />WHEREAS, Developer is the owner of property situated in the City of Little Canada, <br />County of Ramsey, to be platted as The Preserve. <br />WHEREAS, Developer was granted approval of the Preliminary Plat for The Preserve <br />pursuant to Resolution Number 2002 -10 -241 adopted by the City Council of Little Canada at <br />their meeting of October 23, 2002 and Final Plat approval was granted on September 28, 2005, <br />pursuant to Resolution Number 2005 -9 -225. <br />WHEREAS, Developer proposes the construction of certain improvements within said <br />Plat and said improvements include the general improvements to serve the Plat (hereinafter <br />individually and collectively referred to as the "Required Improvements "). <br />WHEREAS, the Developer is preparing final plans and specifications for the Required <br />Improvements. <br />NOW THEREFORE, the City and Developer agree as follows: <br />_1_ <br />
