The Preserve <br />Development Contract <br />Miscellaneous <br />27. Prior to the issuance of any certificate of occupancy for any lot within the plat of <br />The Preserve, Developer shall deed Outlot A for City's use as park area. The City will accept <br />said deed as a gift and acknowledge the receipt of same based on the value determined by a <br />qualified appraiser to be selected and paid for by Developer, at Developer's discretion. <br />28. Prior to final approval of construction plans for the Required Improvements, <br />Developer shall furnish City and its Engineer, a copy of the plans associated with the lowering of <br />the three pipelines contained within the easement owned by Magellan Midstream Partners <br />together with the agreement between the Developer and Magellan Midstream Partners associated <br />with the lowering of the pipelines including statements of their acceptance of responsibility for <br />all work associated with the lowering of the pipelines. The City reserves the right to modify its <br />approval of the balance of the construction plans due to any impacts that the lowering of the <br />pipelines may have on the balance of the Required Improvements. <br />29. The Developer represents that the Plat and Required Improvements will comply <br />with all City, County, Metropolitan, State and Federal laws and regulations, including, but not <br />limited to, subdivision ordinances, zoning ordinances, noise ordinances, and environmental <br />regulations; including wetland impact and mitigation. Developer shall obtain all necessary <br />permits and consents for the Required Improvements including, but not limited to, any permits <br />required by the Minnesota Department of Health for water main extensions, any permits required <br />by the Minnesota Pollution Control Agency for sanitary sewer main extension, any permits <br />required by the Metropolitan Council Waste Water Services Division for connections to sanitary <br />sewer lines, any permits required by the Ramsey- Washington Watershed District for grading and <br />storm water discharge; any permits or approvals necessary to properly comply with Wetland <br />regulations; any permits from the Minnesota Department of Transportation to allow the <br />-8_ <br />- 9 - <br />
