6 <br /> <br />6. The Conditional or Interim Use will not unduly affect natural features. <br />The lot is almost entirely paved with some vegetation on the periphery of the lot. No impact to <br />natural features is anticipated. <br /> <br />RECOMMENDATION <br />City staff are supportive of the Interim Use Permit application and find that the proposal meets the <br />required evaluation criteria. <br /> <br />Staff recommends that the City Council approve an Interim Use Permit for Feelin MN LLC to operate <br />a retail cannabis dispensary at 75 Little Canada Road West, Little Canada, MN 55117, subject to the <br />following conditions: <br />1. The Interim Use shall conform to all applicable zoning regulations. <br />2. The Interim Use shall comply with the Specific Development Requirements for cannabis <br />businesses as outlined in City Code Section 914.070. <br />3. The Interim Use shall comply with all provisions of Chapter 827 (Cannabis) of the City Code. <br />4. The Interim Use shall not impede the normal and orderly use or development of nearby <br />property, substantially diminish nearby property values, or place an undue burden on public <br />facilities or services. <br />5. The Interim Use shall not be detrimental to the health, safety, or welfare of the public. <br />6. The Interim Use shall not result in a nuisance by emissions. <br />7. The Interim Use shall not unduly affect natural features. <br />8. The Interim Use shall comply with all applicable rules and regulations established by the State <br />of Minnesota for cannabis retail operations. <br />9. The Interim Use Permit shall terminate if Feelin MN’s state-issued license (MICRO-A25- <br />001411) for the property at 75 Little Canada Road West expires, is revoked, or is found to be <br />non-compliant by the Office of Cannabis Management. <br />10. The Interim Use Permit shall terminate upon any sale, transfer, or change in controlling <br />ownership of the cannabis business. <br />11. The Interim Use Permit is site-specific and shall not be transferred to another location, except <br />in the event of a subdivision of the approved property by the permit holder. In such case, the <br />permit holder must designate, at the time of subdivision, which of the resulting parcels the IUP <br />will apply to. The IUP shall remain valid only for the designated parcel and may not be <br />transferred to any other property. <br />12.
