MINUTES <br />CITY COUNCIL <br />JANUARY 24, 2024 <br />4 <br />D. Miller referenced setbacks and asked if the DNR sets the lakeshore setbacks. The Community <br />Development Director confirmed that the shoreline regulations include the DNR required setbacks <br />from the lake. She confirmed that residents would still need to obtain building permits. <br />The City Administrator stated that the typical conditions that have been attached to some previous <br />requests have been addressed through the proposed text amendments to make that process unnecessary. <br />Gutierrez commented that she had a previous request to build a garage and was given the condition <br />that their shed would need to be removed. She noted that under the proposed changes it would appear <br />that they would be allowed to keep their shed. The Community Development Director confirmed that <br />to be correct as residents are able to work within the allowed number of accessory structures given that <br />those structures are under the square footage threshold. <br />D. Miller asked if those that received CUPs with more restriction would need to come back for that <br />change. The Community Development Director explained that while the CUP runs with the property, <br />those properties would still be allowed to have what is allowed under the updated regulations and <br />therefore would not need to come back to the City. She stated that staff could revisit those CUP <br />holders that had the condition related to their shed and make them aware of the change. <br />Gutierrez asked and received confirmation that chicken coops are not counted in the square footage. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2024-1-10 –APPROVING ORDINANCE 890, AMENDING <br />CHAPTERS 904, 914, AND 915 OF THE ZONING CODE REGLATED TO GARAGE AND <br />ACCESSORY STRUCTURES AND APPROVAL OF A SUMMARY ORDINANCE TO BE <br />PUBLISHED <br />The foregoing resolution was duly seconded by D. Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />CONSENT AGENDA <br />T. Miller introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2024-1-11 –APPROVING THE CONSENT AGENDA WHICH <br />CONTAINS THE FOLLOWING: <br />x Approval of the Vouchers <br />The foregoing resolution was duly seconded by Gutierrez. <br />Ayes (5). Nays (0).
