2. Revocation for Violations of §146A.08
The ordinance now provides that a local license may be suspended or revoked if a
practitioner engages in prohibited conduct under §146A.08, regardless of whether the
practitioner claims exemption from §146A.

3. Civil Penalties
The ordinance states that any violation is a misdemeanor. Staff would like to allow for the
avenue of civil infraction penalties to be used as well.

Questions for The Council’s Consideration:
1. Do the performance standards (hours, coverings, no locks on interior doors, inspection
access, decorum expectations, no beds or sleeping) appropriately relate to public health,
safety, and welfare concerns associated with touch-based therapeutic environments?

2. Are these standards reasonable and sufficiently clear?

Staff Recommendations:
Staff recommends adoption of Ordinance 921, amending Chapters 2202 and 2203 of the City Code
to regulate non-massage touch-based complementary and alternative health care practices in a
manner consistent with legitimate public health, safety, and welfare objectives.

Attachments:
• Attachment A: Redline Chapter 2202
• Attachment B: Redline Chapter 2203
• Attachment C: Ordinance 921
• Attachment D: Summary Ordinance 921
