b. The applicant has been convicted of or entered a plea of guilty within the previous <br />three (3) years to a violation of this chapter or of any other law regulating the <br />practice of massage, or of any law prohibiting criminal sexual conduct, <br />prostitution, pandering, indecent conduct or keeping of disorderly house. <br /> <br />c. The applicant has not complied with a provision of this ordinance. <br /> <br />d. The applicant is less than eighteen (18) years of age. <br /> <br /> 6. A license to provide massage therapy or complementary and alternative health care <br />practices shall be reviewed annually. No license approved by the City grants the licensee a property <br />right or entitlement to a license. The City Council may refuse to issue, refuse to renew, or may suspend <br />or revoke a license for any reason, and the City will not incur liability for any damages including, but <br />not limited to, direct, consequential, or incidental damages, deprivation of property, loss of income, loss <br />of profits, or loss of livelihood. <br /> <br />2202.050. REVOCATION OR SUSPENSION OF LICENSE. <br />A license may be revoked or suspended for any of the following reasons: <br /> <br />1. Fraud, deception or misrepresentation in connection with the registration application. <br /> <br />2. A violation of any provision of this chapter. <br /> <br />3. Conviction of a criminal sexual conduct, prostitution, pandering, indecent conduct, or <br />keeping a disorderly house. <br /> <br />4. Conviction of any crime or ordinance violation arising out of the practice of massage <br />therapy. <br /> <br />5. Exhibition of a demonstrable lack of skill in the practice of massage therapy. <br /> <br />6. A licensee’s engagement in any conduct prohibited under Minnesota Statutes, Chapter <br />146A.08, shall constitute a violation of this Chapter and grounds for suspension or revocation, <br />irrespective of whether the practitioner claims exemption from or non-applicability of Chapter 146A. <br /> <br />2202.060. RESTRICTIONS AND REGULATIONS. <br /> <br />1. Any person registered as a massage therapist or complementary and alternative health <br />care practitioner hereunder shall display such license, or a true copy thereof, in a prominent place at such <br />person's place of employment. <br /> <br />2. Upon demand of any police officer at the place of employment, any person licensed <br />hereunder shall produce correct identification, identifying himself/herself by his/her true legal name and <br />correct address. <br /> <br />3. During business hours, all massage therapy and complementary and alternative health <br />care establishments shall be open to inspection by City Building and License Inspectors, Health Officers, <br />and police officers. <br /> <br />4. Any person licensed hereunder shall practice massage therapy or complementary and <br />alternative health care practices only at such location or locations as are designated in the license. Any
