(2) The applicant has been convicted within the past five years of any violation of a federal, state, or local law, ordinance provision, or other regulation relating to cannabinoid products or cannabinoid-related devices. (3) The applicant has had a license or retail registration to sell cannabinoid products or cannabinoid-related devices revoked within the preceding 12 months of the date of application. (4) The applicant fails to provide any information required on the application, or provides false or misleading information. (5) The applicant is prohibited by federal, state, or other local law, ordinance, or other regulation from holding a license retail registration. (6) The applicant does not have a pending or approved Minnesota Office of Cannabis Management Lower-potency hemp edible retailers license (b) Except as may otherwise be provided by law, the existence of any particular grounds for denial does not mean that the city must deny the license retail registration. (c) If a license retail registration is mistakenly issued or renewed to a person, it shall be revoked upon the discovery that the person was ineligible for the license retail registration under this section. SECTION 6. The City Council of the City of Little Canada hereby amends Little Canada City Code Section 826.45. Prohibited sales as follows: 826.45 PROHIBITED SALES. It shall be a violation of this section for any person to sell or offer to sell any cannabinoid products or cannabinoid-related devices: (a) To any person under the age of 21 years. (b) By means of any type of vending machine. (c) By means of self-service methods whereby the customer does not need to a make a verbal or written request to an employee of the licensed registered premises in order to receive the cannabinoid products or cannabinoid-related devices and whereby there is not a physical exchange of the cannabinoid products or cannabinoid-related devices between the licensee registrant, or the licensee’s registrant’s employee, and the customer, other than products that are intended to be consumed as a beverage. (d) By means of loosies. (e) By any other means, to any other person, on in any other manner or form prohibited by federal, state or other local law, ordinance provision, or other regulation. SECTION 7. The City Council of the City of Little Canada hereby amends Little Canada City Code Section 826.50. Self-service sales as follows: 826.50 SELF-SERVICE SALES. It is unlawful for a licensee registrant under this section to allow the sale of cannabinoid products or cannabinoid-related devices, other than products that are intended to be consumed as a beverage, by any means whereby the customer may have access to those items without having to request the item from the licensee registrant or the licensee’s registrant’s employee and whereby there is not a physical exchange of the cannabinoid products or cannabinoid-related devices between the licensee registrant or their clerk and the customer.
