City of Little Canada – Accessory Structure Ordinance Updates
Planning Commission Meeting – October 23, 2025
34
New Definitions
Accessory Building: A building that is subordinate to and located on the same lot as the principal
building, and that is used for purposes customarily incidental to the principal use. Accessory
buildings include, but are not limited to, garages, workshops, gazebos, and storage buildings.
Accessory buildings are classified as either attached or detached based on their physical connection
to the principal building.
Accessory Building, Attached: An accessory building that is connected to the principal building
by a contiguous foundation, roof, floor, or wall system. For all regulatory purposes, it is considered
part of the principal building.
Accessory Building, Detached: An accessory building that is not connected to the principal
building by a contiguous foundation, roof, floor, or wall system except for at-grade sidewalks or
pathways.
Accessory Structure, Small Incidental: An accessory structure with a footprint not exceeding
fifty (50) square feet and a height not exceeding eight (8) feet, that is not intended for vehicle
storage or human habitation. Examples include playhouses, chicken coops, garden sheds, and Little
Free Libraries. Small incidental structures must comply with applicable placement and design
standards.
Dwelling Unit, Accessory: A dwelling unit that is subordinate to a principal dwelling, located on the
same lot, and contained within a detached accessory building. An accessory dwelling unit may be
constructed as a new detached structure or by converting all or part of an existing detached accessory
building, such as a garage. ADUs are subject to the requirements of this code.
Patio: A hard-surfaced, at-grade outdoor area designed for seating, recreation, or similar use. A patio is
not supported by footings or posts and is not covered by a roof or other overhead structure.
Pergola: A freestanding or attached structure consisting of vertical posts or columns supporting a roof-
like open framework, typically used to provide partial shade over a patio, deck, or walkway. Pergolas are
not fully enclosed and do not include solid walls. For the purposes of this code, a pergola is considered
roofed regardless of whether the roof is solid, slatted, or open-lattice. Detached pergolas are classified as
accessory buildings.
Porch: A covered, unenclosed structure attached to the exterior of a building, typically at an entrance,
that provides a transition between indoor and outdoor space. A porch may be open or screened but is not
fully enclosed by solid walls or conditioned for year-round habitation.
Walkway: A hard-surfaced path located on private property for pedestrian access between buildings,
parking areas, public sidewalks, or other on-site features. Walkways may consist of pavement, concrete,
brick, stone, or pavers and are intended solely for pedestrian use. Walkways are not designed or permitted
for the movement, parking, or storage of vehicles. Any hard-surfaced area primarily intended for seating,
gathering, or recreation shall be considered a patio rather than a walkway.

Commented [BH61]: Chapter 919 - They are not
numbered just alphabetized
Commented [BH62R61]: Most of the definitions here are
borrowed in whole or part from other municipalities.
Commented [BH63]: Per September PC meeting, ADUs
will be considered definitionally detached structures in Little
Canada.
