<br /> <br /> Staff Report <br /> <br /> <br /> <br />To: Mayor Fischer and Members of the City Council <br /> <br />From: Heidi Heller, City Clerk/HR Manager <br /> <br />Date: December 17, 2025 <br /> <br />Re: LMC Insurance Trust Liability Coverage Waiver <br /> <br />Action To Be Considered: <br />Motion to approve, table, or deny the following: <br />• to not waive our statutory tort limits. <br /> <br />Background: <br />The Council must decide if it wishes to continue to not waive the City’s statutory tort limits for <br />liability coverage. By not waiving our statutory tort limits, we are telling the League of <br />Minnesota Cities Insurance Trust that any claims where statutory limits of liability apply will be <br />governed by those limits, i.e. $500,000 per person and $1.5 million of liability coverage. These <br />limits had been increased over the past number of years in an attempt to prevent them from being <br />legally changed. <br /> <br />In 2015, LMCIT increased the liability limit to those potential claims not covered by statutory <br />limits of liability to $2 million (Federal civil rights claims are one example). <br /> <br />Staff Recommendations: <br />Staff recommends continuing our practice of not waiving our statutory tort limits. <br /> <br />Attachments: <br />• League of Minnesota Cities Insurance Trust Liability Coverage Waiver Form <br />
