39 <br /> <br />City of Little Canada Personnel Policy <br />State or Local Family and Medical Leave Laws and Other City Policies <br /> <br />Where state or local family and medical leave laws offer more protections or benefits to employees, <br />the protections or benefits that are more favorable to the employee, as provided by these laws, will <br />apply. <br /> <br />Employees Covered Under a Collective Bargaining Agreement <br /> <br />The employment terms set out in this policy work in conjunction with, and do not replace, amend, or <br />supplement any terms or conditions of employment stated in any collective bargaining agreement that <br />a union has with the City. Employees should consult the terms of their collective bargaining <br />agreement. Wherever employment terms in this policy differ from the terms expressed in the <br />applicable collective bargaining agreement with the City, employees should refer to the specific terms <br />of the collective bargaining agreement, which will control. <br /> <br />Minnesota Pregnancy and Parenting Leave <br /> <br />The City will grant an unpaid leave of absence to an employee who is: <br /> <br />(1) a biological or adoptive parent in conjunction with the birth or adoption of a child; or <br />(2) a female employee for prenatal care, or incapacity due to pregnancy, childbirth, or related <br />health conditions. <br /> <br />The length of the leave shall be determined by the employee, but must not exceed 12 weeks, unless <br />agreed to by the City. <br /> <br />The leave shall begin at a time requested by the employee. For leave taken under subdivision 1, leave <br />must begin within 12 months of the birth or adoption; except that, in the case where the child must <br />remain in the hospital longer than the mother, the leave must begin within 12 months after the child <br />leaves the hospital. <br /> <br />The City will not retaliate against an employee for requesting or obtaining a leave of absence as <br />provided by this section. <br /> <br />If available, the City will continue to make coverage available to the employee while on leave of <br />absence under any group insurance policy, group subscriber contract, or health care plan for the <br />employee and any dependents. The employee shall bear the costs unless otherwise required by law. <br /> <br />In addition to the above, the City offers parenting leave without pay, not to exceed six (6) months in <br />duration, will be granted upon the birth or adoption of a child (or children) at the employee's request <br />after the employee has exhausted any available leave under Minnesota Paid Leave. This leave may be <br />extended through the use of the employee's accumulated PTO/ESST, sick or Deferred Sick Leave. <br /> <br />School Conference and Activities Leave <br /> <br />The City will provide employees with up to 16 hours of leave during any 12-month period to attend <br />school conferences or school-related activities related to the employee's child (including conferences <br />related to a pre-kindergarten program or childcare services), provided the conferences or school-related <br />activities cannot be scheduled during nonwork hours.
