56 <br /> <br />City of Little Canada Personnel Policy <br />SECTION 22 - NON-DISCIPLINARY SEPARATION <br /> <br />Resignation <br /> <br />A. Any employee wishing to leave the City service in good standing shall file with his supervisor <br />at least fourteen (14) calendar days before leaving a written resignation stating the effective <br />date of this resignation. Failure to comply with this procedure may be considered cause for <br />denying such employee future employment by the City. <br /> <br />B. Unauthorized absence from work for a period of three (3) days may be considered by the <br />supervisor as a resignation. <br /> <br />Severance Pay <br /> <br />All regular full-time and part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for unused Paid Time Off (PTO)/Earned Sick and Safe Time <br />(ESST), sick time and compensatory time subject to maximum accruals. Employees leaving the City’s <br />employ can elect to be compensated for unused accrued PTO/ESST or to have the value of accrued <br />PTO/ESST deposited in the employee’s Post Employment Health Care Savings Plan, Health Savings <br />Account, or 457b retirement account subject to IRS rules and/or election requirements of the Plans. <br /> <br />All regular full-time and regular part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for remaining Deferred Sick Leave balances based on the <br />schedule below. Severance pay based on Employees can elect to be compensated for unused Deferred <br />Sick Leave will only be paid by the City to as a cash payout or to have the value of the unused <br />Deferred Sick Leave deposited in the employee’s Post Employment Health Care Savings Plan, Health <br />Savings Account, or 457b retirement account subject to IRS rules and/or election requirements of the <br />Plans or a combination of the four options. For those employees that opted to convert Deferred Sick <br />Leave to PTO as provided for in the PTO/ESST provision of this policy, the time converted will be <br />deducted from the pay-out maximum below on a one-for-one basis. <br /> <br /> % of Unused Sick To Pay-Out <br /> Leave Balance Maximum <br /> 5 years to less than 10 years of service 30% 10 days (80 hours) <br /> 10 years to less than 15 years of service 35% 20 days (120 hours) <br /> 15 years to less than 20 years of service 40% 30 days (240 hours) <br /> 20 years of service and above 50% 42 days (336 hours) <br /> <br />All regular full-time and regular part-time employees who leave the employ of the City by resignation, <br />retirement, or death shall receive pay for 50% of the remaining Sick Leave balance, up to a maximum <br />of 500 hours. Severance pay based on Sick Leave will be paid by the City to the employee’s Post <br />Employment Health Care Savings Plan, Health Savings Account, 457b retirement account, cash <br />payout, or a combination of the three four options, subject to IRS rules and/or election requirements of <br />the Plans. <br /> <br />ESST hours will not be paid out at separation. If the employee returns to work at the city within 180 <br />days, their previously accrued ESST hour balance will be reinstated. <br /> <br />
