2 <br /> <br /> <br />WHEREAS, the City Council finds that the variance will maintain the essential character <br />of the locality by minimizing grading and alteration of the stormwater pond and allowing the <br />facility to function as an extension of the adjacent transit station and right-of-way environment; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LITTLE CANADA, MINNESOTA, AS FOLLOWS: <br /> <br />Planning Case 1448, specifically the request for a variance to allow the front setback of the <br />principal structure to be 2 feet from the property line, where a minimum setback of 10 feet is <br />required, is hereby approved for the Property subject to the following conditions: <br />1. Development authorized by the variance shall not be carried out until the applicant has <br />secured all other approvals required by the City Code or any other applicable regulations. <br />Approval of this variance does not constitute approval of any other required permit or <br />authorization. <br />2. Development authorized by the variance shall be substantially consistent with the plans <br />and materials submitted with the variance application. Any material deviation shall require <br />review and approval by the City and may require an amended or new variance. <br />3.
