Stat. section 513.55, Subd. 1(a)(2), Buyer states <br />that Buyer intends to use the property as a single - family residence and for the following uses: <br />SELLER'S DISCLOSURE: CONDITION OF THE PROPERTY. <br />PART A: SELLER'S STATUTORY DISCLOSURE. <br />LIST HERE ALL MATERIAL FACTS OF WHICH THE SELLER IS AWARE THAT COULD ADVERSELY AND SIGNIFICANTLY <br />AFFECT: <br />(1) AN ORDINARY BUYER'S USE AND ENJOYMENT OF THE PROPERTY; OR, <br />(2) ANY INTENDED USE OF THE PROPERTY OF WHICH THE SELLER IS AWARE. <br />The City of Little Canada purchased this property in early 2004 due to concerns regarding on -going code <br />enforcement issues with the previous owner. The code enforcement issues we dealt with included illegal <br />parking, construction activity without a building permit illegal duplexing of the structure, and outdoor storage <br />violations. After court proceedings, the previous owner asked the City if we would buy the property. We <br />agreed to do so knowing we would have to re- establish the single family use of the property as well as do <br />substantial remodeling. <br />The previous owner did not make us aware of any problems with the properly. In our ownership of the <br />property, we (lave not witnessed any problems associated with a damp or wet basement. Many of the other <br />problems with the home were corrected with our rehab project. Those items included, but are not necessarily <br />limited to a new furnace, new central air conditioning unit. new wafer heater, new siding, new windows, new <br />exterior cloors, reconstruction of screened patio area, re- landscaping of the front yard area, collapsing and <br />filling of old cesspool (see sewer clisclosure form), new bitirninous driveway. new garage door. new kitchen <br />cabinets, new stove, new range hood, new dishwasher. new kitchen sink, new garbage disposal unit, new <br />dining room light fixtures, new carpeting, and re- grading around the foundation to promote drainage away from <br />the structure. We also installed gutters on the eaves to direct water away from the foundation. We did not re- <br />roof the house as we believe the previous owner did This within the last five years or so and the condition of the <br />roofing appeared good. <br />The property is zoned R -1, Single Family Residential pursuant to the City of Little Canada's zoning ordinance. <br />Mr. Morris has discussed the possibility of constructing a new garage on the property to house his pick-up <br />truck. He has been told that the front yard setback is 30 feet from the property line. The minimum sideyard <br />setback is 7.5 feet. He is also limited to up to 1000 square feet of accessory building space without the need <br />for a conditional use permit. Furthermore, if his new garage is to be detached, a conditional use permit is also <br />needed. (He should consult with the City Planner and the Building Official regarding the specifics of his <br />garage plans to ensure code compliance.) <br />(Use additional sheets if necessary/ <br />23- <br />
