MINUTES <br />PLANNING COMMISSION <br />JANUARY 13, 2004 <br />AMENDMENT - <br />RETAIL AUTO <br />SALES <br />CONDITIONAL <br />USE PERMIT - <br />3173 -3177 <br />SPRUCE STREET - <br />RICK IGO <br />vehicles sales Lots in the B -4 District and eliminates these lots from the <br />B -W and I -P Districts. The Planner noted that in a previous amendment to <br />the B -W District, the link was severed which provided this type of license <br />to roll over into the B -4 District. <br />The next amendment establishes a new type of license, that is a motor <br />vehicles and recreation equipment sales (indoor) license as a Conditional <br />Use in the I -1 Zoning District. The third amendment re- establishes the <br />link providing for motor vehicle sales lots (outdoor) as a CUP in the I -1 <br />District. <br />With regard to the indoor sales license, the Planner indicated that the State <br />requires that any retail motor vehicles sales license have designated <br />vehicle parking areas, whether indoor or outdoor. The Planner noted that <br />outdoor vehicles sales lots have been a focus of code enforcement activity <br />for the City. Requiring both indoor and outdoor sales lots to be allowed <br />by Conditional Use Permit in the I -1 District provides the City with <br />additional control. The Planner indicated that the indoor sales license is <br />essentially an office function; but again, the State requires the <br />demonstration that vehicles can be stored on -site. For the indoor license, <br />these spaces would be indoor spaces. <br />Duray recommended adoption of an ordinance amending Chapters 911 <br />and 914 of the Little Canada City Code, known as the Zoning Ordinance, <br />by providing for motor vehicle sales in the 1 -1, Light Industrial Zoning <br />District, as proposed by the City Planner. <br />Motion seconded by Weihe. <br />Motion carried 6 — 0. <br />Rick Igo, 3173 -3177 Spruce Street, requested a Conditional Use Permit <br />for a retail motor vehicles and recreational equipment sales (indoor) <br />license as just discussed. Igo reported that he renovates motorcycles on <br />a part -time basis and then sells the renovated bikes. The bikes are then <br />sold when the renovation is completed. Igo reported that he may renovate <br />and sell five or six motorcycles per year. He reviewed the site plan with <br />the Commission noting that his indoor storage area would be within the 16 <br />foot by 40 foot office area shown on his site plan. Igo reported that there <br />would be little storage at this location as web as very little customer <br />traffic. Igo indicated that to meet requirements for a State retail motor <br />vehicle sales license (indoor) he needs a sales office where sales records <br />are maintained as well as a designated indoor storage area. <br />-2- <br />
