d. Each application for cc temporary sign shall be accompanied by a fee, set by <br />resolution of the City Council, which shall cover the administrative expenses <br />of the permit. In addition, each application shall be accompanied by a <br />deposit, set by resolution of the City Council, which shall be returned to the <br />applicant upon request, and only in the event that the temporary sign has been <br />removed by the date of the expiration of the permit. In the event that the sign <br />is not removed by the permit expiration date, the City shall not refund the <br />deposit, The City may apply other enforcement remedies as well. <br />The underlined portion of the ordinance is causing the most consternation for businesses located <br />in multiple tenant buildings. (Market Place, Thunder Bay Plaza, Round Lake Plaza, Strip Center <br />at Lakeshore and LC Road, and the strip mall Goodyear is located in on Rice Street.) Most <br />centers do not regulate or coordinate their tenant's use of temporary signs. Therefore, one <br />business may use up the allotted permits (staff does not want to be the referee on this matter and <br />we issue the penuits first come, first served). Another problem arises when one business has (or <br />has had) a permit and prevents another business from obtaining one pursuant to the code <br />Mr. Linn was informed of the Council's concern aimed at preventing a proliferation of these <br />signs. I also believe any changes to the current provisions will result in more temporary signs <br />being present within the City. Mr. Linn asked if he could address you on this topic.
