PERMANENT PUBLIC SIDEWALK, TRAIL, UTILITY AND DRAINAGE <br />EASEMENT <br />THIS AGREEMENT made this day of September, 2005, by and <br />between LCA- Little Canada, LLC, Grantor, and the City of Little Canada, a <br />municipal corporation under the laws of the State of Minnesota, Grantee; <br />WHEREAS, Grantor is the owner of certain real property located in <br />Ramsey County, Minnesota and legally described on Exhibit A attached hereto <br />( "Property "); <br />WHEREAS, Grantor desires to grant to the Grantee an easement for the <br />purposes of sidewalk/trail, utility and drainage purposes over designated areas of <br />the Property; <br />AGREEMENT <br />NOW, THEREFORE, in consideration of One Dollar ($1.00) and other <br />good and valuable consideration and in consideration of the covenants contained <br />herein, the parties agree as follows: <br />1. Grant of Easement. That the said Grantor, in consideration of good <br />and valuable consideration, the receipt of which is hereby acknowledged, hereby <br />grants and warrants to said Grantee, its successors and assigns, a permanent <br />non - exclusive easement for public sidewalk /trail, utility and drainage purposes, <br />and for ingress and egress to such public sidewalk/ trail, at any and all times with <br />all machinery, equipment and materials necessary for the aforesaid purpose, in, <br />2 <br />
