MINUTES PLANNING COMMISSION MAY 12, 2005 The City Planner asked what type of materials McGough would store outdoors at the Spruce Street site. Brill replied that McGough would store such items as flatbed trailers, scaffolding, portable generators, air compressors, small cement mixers, etc. Duray noted that Orius has storage outside the fenced area. The Planner indicated that all items outside the fenced area are in violation of the CUP. Duray reported that he visited the Orius site today and measured the fence, which he determined to be 8 feet high. Brill indicated that McGough would be willing to construct a higher fence, but noted that anything higher than 8 feet would have to be engineered for wind loads, etc. The City Planner noted that the McGough CUP request is not on the agenda, and McGough has been informed that a CUP application would not be entertained until the moratorium is lifted. The task for the Commission this evening is to consider whether or not any changes are necessary to the Code relative to outdoor storage in the I -P District. Brill indicated that his request this evening would be for the Commission to act on the outdoor storage issue and pass it on to the Council so that the moratorium could be lifted. Brill indicated that they are hoping to be able to make application for the June planning cycle. Brill again indicated the fencing improvements that would be made to the 3250 Spruce Street site as well as the addition of landscaping outside the fenced area. The City Planner indicated that the purpose of his May 12th report is to highlight discussion points relative to open and outdoor storage in the I -P District. He noted that Brill raises one additional discussion point, which is the definition of screening. Tony Gleekel indicated that Hillcrest Development wants to do a deal with McGough Construction. However, the moratorium could last several months preventing this deal. He also noted that the way the property is marketed will depend on what the City does with the outdoor storage issue. Gleekel indicated that outdoor storage is a typical use in industrial zoning districts. Gleekel noted that the City has concerns with the three - year old CUP with Orius given the unsightly condition of the property. Gleekel felt that the outdoor storage problem was more of an enforcement issue. Gleekel noted that the Conditional Use Permit runs with the land, and there is some debate whether a new occupant of the property would be able to comply with the conditions of the Orius CUP. Gleekel felt that another telecommunications company would be able to comply with the CUP granted to Orius. Gleekel also felt that McGough Construction might be a preferred user than another telecommunications company and - 7 -
