RESOLUTION <br />WHEREAS a preliminary plat was approved for The Preserve on October 23, 2002 <br />subject to numerous conditions, and <br />WHEREAS, the developer of The Preserve has stipulated agreement to all of the <br />conditions of the preliminary plat approval except for the following: <br />1. Moving Preserve Court off of William's Pipeline Easement <br />2. Centering of Preserve Trail on the lot that it is proposed to be located within <br />3. Compliance with Little Canada's Pipeline Setback Policy <br />4. Combining the two lots at the east end of the property (fo ,uerly Lots 1 & 2, <br />of Block 2) into one lot to provide proper lot width requirements and <br />additional spacing from the pipeline, and <br />WHEREAS, after denial of a proposed final plat on August 28, 2002, the developer has <br />now submitted a revised final plat, and <br />WHEREAS, the proposed final plat and related documents submitted on September 15, <br />2005 more closely resembles the intent of preliminary plat approval, and <br />WHEREAS, developer has now proposed locating Preserve Court off of the pipeline <br />easement, has effectively centered Preserve Trail between existing properties, and has <br />combined the two lots proposed at the east end of the development into one lot (Lot 14, <br />Block 1), and <br />WHEREAS, staff has completed their review of developer's final plat submittals, and <br />WHEREAS, staff has recommended approval of the final plat subject to a number of <br />terms and conditions, <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LITTLE CANADA, MINNESOTA that the final plat for The Preserve be approved <br />subject to the following terms and conditions as prepared by City Staff: <br />City Planner Recommendations: <br />1. Pipeline company execution of a release of the easement covered by Preserve <br />Court right of way in recordable form. <br />2. Verification by the City that the new easement area traded to the pipeline <br />company in retum for the release of the blanket easement will not raise new planning <br />or engineering issues for the City. <br />3. Verification that evergreen trees proposed for the right of way of Preserve <br />Court will be planted no closer than nine feet from the curb. <br />4. Verification that all trees planted within 60 feet of the intersection of <br />Preserve Court and Preserve Trail to be deciduous species. <br />5. Relocation of the building pad for Lot 1, Block 2 as far to the north as <br />practical to increase buffer distance from the pipeline. <br />- 1 - <br />
