The Zoning <br />Ordinance currently provides for open or outdoor service, sale, and rental by <br />Conditional Use Permit only in the B -2 Zoning District. This provision does not roll over <br />into the B -3 District, and as such, an amendment is necessary to consider outdoor sales <br />for this applicant. <br />The primary concern for this use relates to unsightly proliferation of materials in outside <br />areas, and distinguishing outdoor sales from outdoor storage. The City has <br />discouraged outdoor storage in commercial districts, and eliminated it from the B -3 <br />District several years ago. If it is to be reintroduced, it should be carefully controlled to <br />avoid the issues noted above. Draft language is suggested below: <br />912.030.I. Outdoor display of retail merchandise accessory to a retail sales facility, <br />provided that: <br />1. The merchandise being sold is a part of the array of merchandise also sold <br />indoors on the premises in question, and is not being sold "on consignment" <br />or for another off - premises seller. <br />2. The merchandise being displayed, or the display area, does not include any <br />advertising, material, or messages that could be construed as a sign under the <br />
