MINUTES CITY COUNCIL, OCTOBER 23, 2002 The City Planner noted his recommendation for the combination of Lots 1 and 2, Block 2 into a single lot. The Planner noted that McDonell's current proposal to eliminate the outlots would be an attempt to retain these two lots as separate parcels. Fahey suggested that the Council act on the preliminary plat and give the developer guidance on what is acceptable to the City. Fahey indicated that normally he would favor denial of a plat that has as many outstanding issues as this one does, but in fairness to the developer, felt it was better to give clear direction so that they can deter nine whether or not they want to proceed with the development. There was no one else present from the general public wishing to comment on this matter. Upon motion by LaValle, seconded by Montour, the public hearing was closed. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 2002 -10 -241 - APPROVING THE PRELIMINARY PLAT FOR THE PRESERVE SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER, CITY ENGINEER, CITY ADMINISTRATOR, AND PLANNING COMMISSION, AND SUBJECT TO COMPLIANCE WITH THE CITY'S 50 -FOOT PIPELINE SETBACK POLICY AND SUBJECT TO VERIFICATION OF THE LOCATION OF THE WILLIAMS PIPELINE EASEMENT THROUGH TITLE WORK The foregoing resolution was duly seconded by LaValle. Ayes (4) Fahey, LaValle, Montour, Anderson. Nays (I) Scalze. Resolution declared adopted. RECESS At this point in the meeting, 10:00 p.m., Council took a short recess. The meeting was reconvened at 10:07 p.m. HISTORICAL Jean Donovan, Little Canada Historical Society, presented the Council with SOCIETY a $5,000 donation as repayment for the City's debt on the Historical Society Building addition. Donovan reported that to date, they have repaid $201,176 of the debt and have a balance due of $84,556. Mayor Fahey thanked the Historical Society for their diligent efforts in making this repayment. 17 - 2 2 -
