4 <br />this way, tied directly to the lots, and issues such as tax forfeiture or City assessments against <br />the outlot do not become a concern. <br />Other Issues. The Parks Commission recommended that a future trail should be <br />accommodated through the wetland area. To accomplish this, a trail easement would be <br />necessary over the wetland area (in addition to the utility and drainage easement already <br />shown), and access to the wetland would be necessary along the western plat boundary. <br />Access on the east side of the plat can be gained from the cul -de -sac of Preserve Court. These <br />easements would need to be provided via a separate document, as trail easement notations are <br />not typically permitted on the final plat. <br />Summary and Recommendation <br />The proposed plat consists of a total of 14 lots, each of which meet or exceed the minimum R- <br />1 and Shoreland zoning requirements. The planning conditions applied to the Preliminary <br />Plat approval have been met, subject to the following items: <br />a. Verification of the pipeline easement release as discussed in Item 1 of this report. <br />b. Verification that evergreen plantings within the south boulevard portion of <br />Preserve Court right of way are no closer than 9 feet from the curb, and 60 feet <br />from the intersection with Preserve Trail. <br />c. Landscaping along the wetland edge is included, consistent with the condition of <br />the original Preliminary Plat approval. Planning staff recommends 60 to 70 <br />overstory trees to supplement the few remaining trees, as identified in this report. <br />d. Changes to the Covenants are made to replace Homeowners' Association Outlot <br />ownership with equal undivided interests in the Outlots by each lot owner. <br />e. Trail easement documents are executed to provide pedestrian access from public <br />rights of way to and across the wetland area, including trail easement along the <br />west plat boundary to the wetland. <br />City Administrator: <br />1. Documentation from Magellan and the Developer regarding the details <br />involving the proposed lower of the pipeline(s) under Preserve Trail to <br />facilitate a better grade transition between Preserve Court and Preserve Trail. <br />This is a key factor in making the proposed development acceptable to the <br />City. This documentation must be sufficient to provide us with all details of <br />construction and any conditions imposed /required by Magellan involving the <br />pipelines, evidence of all required permits necessary for this work as required <br />by local, state, and federal taws, comments by the Minnesota Office of Pipeline <br />Safety to ensure all reasonable and appropriate measures are being taken to <br />protect public safety. This condition is imposed pursuant to 1008.010 (f). <br />2. Magellan releasing 10 feet of their pipeline easement in order that developer <br />can provide a 50 -foot right -of -way for Preserve Court that is unencumbered by <br />
