Memo <br />Ill-ERIN( -ASSOCIATES <br />TO: Mayor Blesener & Members of the City Council <br />FROM: Lee Elfering, City Engineer <br />DATE: September 9, 2005 <br />RE: Public Hearing <br />Park Street Vacation <br />The vacation of Park Street is being brought before the Council for a public hearing. <br />There are no plans to improve Park Street to a public street and at this time we do not <br />see the need in the future. Therefore, we believe vacation of the street would be a <br />beneficial option to for both the City and adjacent property owners. <br />We have spoken to Ramsey County and it appears that if the vacation is completed on <br />the entire street half (30 -feet) would revert back to Terrace Heights Mobile Home Park <br />and the other half (30 -feet) would revert back to the school property. It was our original <br />intent to recommend vacation of the entire width of the street right -of -way. However, in <br />review of the existing mobile home park private road location, vacating the entire right - <br />of -way width would present a problem for Terrace Heights. The existing road utilized by <br />Terrace Heights for access to County Road B2 extends approximately 5 feet to the east <br />of the right -of -way centerline. Therefore, if vacated in its entirety, the existing mobile <br />home park private street would lie partially within the school property. Three possibilities <br />would exist to resolve this situation. They are as follows: <br />1. The school could grant the mobile home park an easement to allow the street to <br />remain on their property. <br />2. Terrace Heights could shift the street five feet to the west thereby removing it <br />from. <br />3. We could only vacate the east 20 feet of street right -of -way. This would eliminate <br />any potential issues with the access road to the mobile home park and allow both <br />property owners full use of the road. <br />The City does have sanitary sewer running down Park Street so we would recommend <br />maintaining a drainage and utility easement over any vacated areas. Based on the <br />result of our research we would recommend that the City Council vacate only the east 20 <br />feet of the right -of -way and maintain a drainage and utility easement over the area.
