RESOLUTION <br />WHEREAS, <br />The City of Little Canada and the Guerin Family executed a Stipulated Settlement <br />Agreement on May 23, 2001 which provides that proceeds in the Guerin Settlement Fund <br />would only be used to pay for the clean up of the property at the northeast corner of Rice <br />Street and Little Canada Road to the extent other sources of funds for clean up or <br />redevelopment are not available; <br />AND WHEREAS, <br />The City of Little Canada submitted a grant application on April 29, 2005 to the <br />Department of Employment and Economic Development (DEED) for clean up of the <br />property referenced above; <br />AND WHEREAS, <br />DEED, by correspondence dated July 15, 2005, approved the City's grant application <br />with the stipulation that the Guerin Settlement Funds for contamination clean -up he <br />utilized prior to DEED grant funds; <br />AND WHEREAS, <br />Based on the Stipulated Settlement Agreement referenced above, it is the Guerin <br />Family's position that DEED grant funds should be the used to reimburse clean -up costs <br />prior to the use of Guerin Settlement Funds. <br />NOW, THEREFORE, BE IT RESOLVED BY THE OF THE CITY OF LITTLE <br />CANADA that the Council requests DEED amend its grant agreement for clean -up funds <br />whereby the Guerin Settlement Funds would become the second source of funding, <br />thereby making DEED funds primary. <br />William Blesener, Mayor <br />Attest: <br />Joel Hanson, City Administrator <br />Adopted this 24th day of August, 2005. <br />
