Hanson <br />www. ci.littte- canada. mn. us <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Kathy Glanzer, City Clerk <br />DATE: August 17, 2005 <br />RE: On -Sale Liquor License /Caterer's Permit <br />Under State Statute, the City of Little Canada is authorized to issue a total of eight (8) <br />On -Sale Liquor Licenses. As you can see from the attached, the City is authorized six (6) <br />licenses under State Statute 340A.413, plus an additional two (2) licenses by special <br />legislation enacted in 1987. However, in discussing this with Al Erickson of the State <br />Liquor Control Division, he informed me that in 2002 the Legislature enacted <br />340A.413.Subd.4. (attached) which excludes certain On -Sale Licenses from these limits. <br />The result is that the typical "bar" liquor establishment falls under the limitation of eight <br />(8) licenses, while the others listed in Subd. 4. do not. Therefore, under State Statute, the <br />City can issue any number of On -Sale Liquor Licenses to the entities listed in this <br />subdivision. <br />The Little Canada Municipal Code restricts the number of On -Sale Liquor Licenses to a <br />total of six (6), with one (1) of these licenses restricted to an On -Sale Restaurant <br />Intoxicating Liquor License as defined by the City's Code. Please also note that there are <br />currently five (5) On -Sale License in effect for the 2005/2006 license year. <br />With regard to Caterer's Permit, there are two classes of permits, one which allows the <br />caterer to sell intoxicating liquor in addition to the food service provided and one that <br />allows for food catering only. I have attached the MN Statute section which addresses <br />the Caterer's Permit that allows for the sale of intoxicating liquor. You will note that this <br />permit requires that the caterer also hold an On -Sale Intoxicating Liquor License issued <br />by any city. In the case of The Little Venetian, if Little Canada issued an On -Sale Liquor <br />
