[DORSEY
STEVEN K. CHAMPLIN
(612) 340-2913
FAX (612) 340-2868
champlin.steve@dorsey.com
August 1, 2005
City of Little Canada
Attn: Mayor Bill Blesener
Little Canada City Center
15 Lithe Canada Road East
Little Canada, MN 55117 -1600
Re: Acquisition of Property Owned by MAC Properties, Inc.
Dear Mayor Blesener:
Dorsey & Whitney LLP represents MAC Properties, Inc. ( "MAC "), owner of property
identified as PID Number 062922220015, located off Woodland Avenue in Little Canada,
consisting of approximately 3.83 acres (hereafter "the Property "). The City, we understand, is
considering acquisition of the Property. I am writing to you in that regard.
MAC and its construction affiliates currently use, and have used for sometime, the
Property for outdoor storage of construction materials, equipment, and trailers. The Property is
an extremely important component of the business of MAC and its affiliates. Its location
significantly contributes to the ability of MAC and its construction affiliates to perform work in the
Twin Cities area on a cost- effective basis, and to their ability to compete. MAC and its affiliates
have bid on and contracted for work, based on the assumption that they would have continued
use of the Property for outdoor storage.
As you know, the City has discussed eliminating outdoor storage use and has in place a
moratorium on future land use for outdoor storage.- Other cities in the Twin Cities area. likewise,
have eliminated and /or restricted outdoor storage use. This fact means that there is an
extremely limited supply of properties available for outdoor storage use in general and, indeed,
there may not be any properties suitable for use by MAC and its affiliates.
The City is currently considering acquisition of the Property for a new public works
garage. MAC has previously advised the City of the significant adverse impact on its business if
the City were to acquire the Property. However, in view of the fact that the City has continued to
consider acquisition of the Property, in spite of MAC's previous input, MAC has asked us to
write this letter to make sure the City understands MAC's position.
MAC hereby requests that the City reconsider current thoughts regarding acquisition of
the Property and focus its attention elsewhere for the new public works garage for the following
reasons:
DORSEY & WHITNEY LLP • WWW.DORSEY.COM ^ T 612.340.2600 F 612.340.2868
SUITE 1500 , 50 SOUTH SIXTH STREET • MINNEAPOLIS, MINNESOTA 55402 -1498
USA CANADA EUROPE ASIA
