MINUTES <br />PLANNING COMMISSION <br />MARCH 11, 2004 <br />PROPERTY <br />COMBINATION <br />& REZONING — <br />450 LITTLE <br />CANADA ROAD — <br />ST. JOI -IN'S <br />CHURCH <br />VARIANCE <br />FROM SIGN <br />ORDINANCE — <br />ALDI FOODS <br />Motion carried 5 — 0. <br />Greg Truhler, representing St. John's Church, appeared before the <br />Commission requesting the combination of the former Maryhouse <br />property with the St. John's Cemetary property into one lot. Tnihler <br />also requested approval of the Rezoning of the former Maryhouse <br />property from Single - Family (R -1) to Public (P). Truhler reported <br />that St. John's will continue to use the two houses on the property <br />as they are currently being use, one is a rectory and the other a shelter for <br />women and children in crisis. The purpose of the request is to ensure that <br />the property stay under Church ownership given the long -term need for <br />additional cemetery space. However, the homes will continue to be used <br />as they currently are until that the use of the homes is no longer feasible. <br />Deis asked about the non- conforming status mentioned in the City <br />Planner's report. The City Planner indicated that the residential use would <br />be considered a long -term non- conformity and the goal would be that <br />these homes not return to market residential property. <br />Weihe asked about the ability to make improvements to the homes. The <br />Planner indicated that the Code allowed some limited expansion of non- <br />conforming residential uses as well as maintenance improvements. <br />However, if the homes were destroyed by over 50% of their value, the <br />Code would not allow the homes to be reconstructed. The Planner noted, <br />however, that there is currently pending legislation that would require <br />cities to allow reconstruction of a non- conforming home. <br />Keis recommended approval of the Property Combination of the former <br />Maryhouse property with the St. John's Cemetary property into one parcel <br />as well as a Rezoning of the former Maryhouse property from Single - <br />Family Residential (R -1) to Public (P) as requested by St. John's Church <br />subject to compliance with the recommendations of the City Planner. <br />Motion seconded by Duray. <br />Motion carried 5 — 0. <br />Jesse Anesi, ARE Foods, appeared before the Commission requesting a <br />Variance from the Sion Ordinance to allow two building signs plus one <br />pylon sign for Aldi Foods at 2350 Rice Street. Anesi described the <br />building, pointing out that the location for the two building signs. Anesi <br />presented pictures of Snvders. US Banlc, Goodyear, Arby's, and Bally's all <br />
