MINUTES PLANNING COMMISSION APRIL 8, 2004 PRELIMINARY PLAT & REZONING — COLLOVA ESTATES Zoch asked if the wood chips will be removed from the berm. Wilson pointed out that that is another issue. However, if the second building is constructed, the berm will be removed and landscaped with grass and trees. Knudsen recommended approval of the Conditional Use Permit for a special purpose fence that will serve as a noise barrier for the existing generator at 2925 Country Drive as requested by RAB, LLC subject to compliance with the recommendations of the Public Works Director. Motion seconded by Rheaume. Motion carried 6 — 0. The City Planner reviewed the proposed Preliminary Plat for Collova Estates consisting of five two -unit townhomes for a total of ten townhome units as well as the request to Rezone the property from Single- Family Residential (R -1) to Medium- Density Residential (R -2). The Planner noted that the property and proposed development extends into Vadnais Heights. The Planner further reported that the property owners are proposing the development of their property at this time given MN DOT's Unweave the Weave project. If the property is not developed, MN DOT will not extend a freeway sound wall in this area. However, given the development of the property and if the density of the development meets the required standards, MN DOT will construct a sound wall as part of the Unweave the Weave project. Barraclough pointed out that the property is low and suggested that the townhomes will have to be slab -on -grade construction. Barraclough suggested that the rezoning would be appropriate as this would not be a highly desirable residential neighborhood. The City Administrator pointed out that there is a powerline through the area as well as wetland constraints. The Administrator reported that MN DOT is currently reviewing the proposed Preliminary Plat and will determine whether it meets density requirements. MN DOT's criteria for sound wall construction also require 'Preliminary Plat approval by May I, 2004 and Final Plat approval by the summer of 2006. The Administrator indicated that staff is recommending a conditional Preliminary Plat approval at this time.
