MINUTES <br />PLANNING COMMISSION <br />APRIL 8, 2004 <br />PRELIMINARY <br />PLAT & <br />REZONING — <br />COLLOVA <br />ESTATES <br />Zoch asked if the wood chips will be removed from the berm. Wilson <br />pointed out that that is another issue. However, if the second building is <br />constructed, the berm will be removed and landscaped with grass and <br />trees. <br />Knudsen recommended approval of the Conditional Use Permit for a <br />special purpose fence that will serve as a noise barrier for the existing <br />generator at 2925 Country Drive as requested by RAB, LLC subject to <br />compliance with the recommendations of the Public Works Director. <br />Motion seconded by Rheaume. <br />Motion carried 6 — 0. <br />The City Planner reviewed the proposed Preliminary Plat for Collova <br />Estates consisting of five two -unit townhomes for a total of ten townhome <br />units as well as the request to Rezone the property from Single- Family <br />Residential (R -1) to Medium- Density Residential (R -2). The Planner <br />noted that the property and proposed development extends into Vadnais <br />Heights. The Planner further reported that the property owners are <br />proposing the development of their property at this time given MN DOT's <br />Unweave the Weave project. If the property is not developed, MN DOT <br />will not extend a freeway sound wall in this area. However, given the <br />development of the property and if the density of the development meets <br />the required standards, MN DOT will construct a sound wall as part of the <br />Unweave the Weave project. <br />Barraclough pointed out that the property is low and suggested that the <br />townhomes will have to be slab -on -grade construction. Barraclough <br />suggested that the rezoning would be appropriate as this would not be a <br />highly desirable residential neighborhood. <br />The City Administrator pointed out that there is a powerline through the <br />area as well as wetland constraints. The Administrator reported that MN <br />DOT is currently reviewing the proposed Preliminary Plat and will <br />determine whether it meets density requirements. MN DOT's criteria for <br />sound wall construction also require 'Preliminary Plat approval by May I, <br />2004 and Final Plat approval by the summer of 2006. The Administrator <br />indicated that staff is recommending a conditional Preliminary Plat <br />approval at this time. <br />
