EXHIBIT C WAIVER OF RIGHT TO APPEAL FROM SPECIAL ASSESSMENT OF LITTLE CANADA IMPROVEMENT PROJECT 2000 -16 The undersigned, Rob Carlson of Rob Carlson Builders, Inc., is the owner of the following - described property located in the City of Little Canada, County of Ramsey, State of Minnesota, which is legally described as follows: Lot 1, Block 1, HAMEL ESTATES subject to easements of record. The undersigned, his successors, representatives, and assigns understand and agree that the sum of $5,493.64, a portion of the cost of Little Canada Improvement Project 2000 -16, relating to the construction of streets, appurtenant drainage system, and water main within the Twin Lake area, as described in the City Engineer's Feasibility Report, dated December, 2000 is to be assessed against the above - described property. The undersigned further understands and agrees that the assessment shall be made pursuant to Minnesota Statutes Chapter 429, and shall be certified for payment to the Department of Taxation for Ramsey County. The undersigned, his successors, representatives, and assigns understand and agree that an additional sum of $1,500.00, shall also be assessed to each designated water service if the extension of Little Canada water main to serve the Twin Lake area proceeds versus the use of Vadnais Heights water main. The undersigned further understands and agrees that if such assessment is levied, the assessment shall be made pursuant to Minnesota Statutes Chapter 429, and shall be certified for payment to the Department of Taxation for Ramsey County. The undersigned understands and acknowledges that the special assessment of $6,350.79 could be challenged and that a court would independently review the propriety of the assessment and would uphold the assessment only upon a finding that each of the following have been established: - 1 6 -
