Lot Configuration. While it is acknowledged that the proposed lot configurations follow <br />the wetland boundary, it is suggested that Lot 1 be reconfigured to devote the narrow, <br />60 foot wide portion (in the extreme northeast corner) as part of the adjacent outlot. To <br />be noted as that following the imposition of building setbacks, such area is not <br />considered buildable. <br />Setbacks. As a condition of preliminary plat approval, a determination should be made <br />that the proposed subdivision will not result in the creation of any non - conforming <br />setbacks. Such determination cannot be made until the home location of the property <br />has been identified. <br />Easements. It has not been indicated whether or not a drainage and utility easement <br />presently exists over the site's wetland. The City Engineer should provide comment <br />and recommendation regarding easement related issues. <br />Street Vacation. As previously indicated, the applicant has requested the vacation of <br />the segment of 5th Avenue which overlays the property. Considering that the street is <br />unimproved and lies within an existing wetland, such vacation is considered generally <br />acceptable. This issue should however, be subject to comment and recommendation <br />by the City Engineer. <br />Also to be noted is that the requested street vacation will require separate action by the <br />City Council. <br />RECOMMENDATION <br />Based on the preceding review, our office recommends approval of the proposed <br />preliminary plat (replat) subject to the following conditions <br />1. Lot 1 be reconfigured to devote the narrow, 60 foot wide portion (in the extreme <br />northeast corner) as part of the proposed outlot. <br />2. The applicant demonstrate that the proposed lot line adjustment will not result in <br />the creation of any non - conforming setbacks. <br />3. The City Engineer provide comment and recommendation regarding easement <br />related issues. <br />4. The City Engineer provide comment and recommendation in regard to the <br />proposed vacation of 5th Street. <br />5. The City formally vacate the segment of 5th Street. <br />6.
