I- (arson <br />Mr. Frank Frattalone on behalf of St. John's Church is requesting approval for fill /excavation permit for 450 Little <br />Canada Road to excavate approximately a minimum of 6 feet below the finished grade and place 4,000 cubic yards <br />of clay material to level the area for the placement of future graves. See attached sketch. <br />During the review of this fill /excavation permit it was determined that the reason for this fill material was to enable <br />future expansion of the adjacent cemetery and the placement of graves in clay material. Since the property was <br />zoned R -1 and this zoning does not include a cemetery use, staff felt that prior to approval of the fill /excavation <br />permit, the applicant should first obtain approval to have it rezoned to a use that permits cemeteries. The applicant <br />has requested that this property be combined with the cemetery property to the east and it be rezoned Public. <br />I have reviewed the request and visited the site. The area to be excavated and filled is the low area between the two <br />houses. The proposed project will level the area, however, the existing drainage conditions will not be changed by <br />this work, therefore, no drainage issues have been created by this project. In addition, there is a Metropolitan <br />Council sanitary sewer easement on this property. Care should be taken when working within this area and no <br />gravesites should be located within this easement area. <br />Since more than 100 cubic yards of material is being filled /excavated, City council approval is required. It is <br />recommended that the Little Canada City Council approve Mr. Frattalone's request to excavate a minimum <br />of 6 feet below the finish grade and place approximately 4,000 cubic yards of clay fill, on St. John's Church <br />property at 450 Little Canada Road, subject to the following conditions: <br />1. Silt fence shall be install along the toe of the area to be excavated and /or filled until vegetative cover <br />is established. <br />2. The area shall be seeded or covered with sod as soon as possible to reduce soil erosion in the area. <br />3. The tracking of material onto Little Canada Road shall be kept to a minimum. In addition, a plan to <br />cleanup any material that inadvertently does go onto Little Canada Road shall be developed and <br />approved by the City prior to commencement of work. <br />4. No gravesites shall be place within the Metropolitan Council Environmental Services Sanitary Sewer <br />Easement. <br />5.
