I am requesting
two separate actions on the property they owned in Little Canada at 2367 McMenemy
Rd. I am petitioning for the vacation of easements rights of the city for Fifth Avenue
which cuts through the property between Block 13 and Block 4, and a partition of the
plat, dividing the property into marsh land, and high ground, the site which is now
occupied by the existing dwelling.
I am requesting the vacation of Fifth Avenue as it crosses environmentally fragile wet
land and I would not want a road put though this protected wet land. Also, William's
Pipeline is placed directly in the area of the plotted roadway. I am requesting the
division of the parcel into two distinct parcels, a marsh land area to be held as
conservation wet land, and the existing dwelling.
Enclosed are the following documents:
The Application Fee of $200 for the vacation of Fifth Avenue and fee of $700 for the
division of the parcel, and a signed Executed Cost Agreement.
A copy of the Certified Survey Specification completed by Milner W. Carley and
Associates. I have been in contact with this land surveyor and when the city has
approved the partition, the survey will be completed with the property lines of the two
sections staked. 1 will retain ownership of the marsh land and keep it as a conservation
wet land, my daughter and son -in -law, Tonia and Brian Bevers, will purchase the house
on the high ground parcel.
A copy of the site plan drawn when the sewer lines were installed.
